Land Registry: “Digital Property Transfer File”

The “Digital Property Transfer File”, a new service of gov.gr that unifies and simplifies the procedures for the transfer of cadastral properties, was launched a few days ago.

According to the Ministry of Digital Governance, bureaucratic steps are significantly reduced by using the Transfer Envelope since 4 documents are eliminated:

  • The Certificate of Non-Obligation of VAT
  • The issuance of the LAD (Extract from the Land Register)
  • The Application for Registration
  • The Contract Summary

The physical presence in Land Registry Offices is also abolished for those who use the Transfer Envelope, while it is also stressed that the Property Code Number (CIN) is “locked” for the duration of the transaction in order to increase security in transactions.

Following the launch of the Digital Property Transfer File, a new decision published in the Official Gazette amended the procedure for the electronic submission of applications for the registration of recordable deeds and the issuance of certificates at the Land Registry Offices and the branches of the Hellenic Cadastre.

Specifically, as stated in the first article of the new decision, after article 3 of the decision of the Board of Directors of the Hellenic Cadastre of N.P.D.D. 177/11/17.03.2022 “Regulation of issues for the electronic submission of applications for the registration of registrable deeds and the issuance of certificates at the Cadastral Offices and Branches of the N.P.D.D. Hellenic Cadastre (V’ 1550), Article 3A is added as follows:

“3Α. For each submitted through the platform of the Electronic Property File of article 29 of Law No. 4821/2021, from the start of its productive operation under the joint decision of the Ministers of Finance, Labour and Social Security, Environment and Energy, Digital Governance, State and the Governor of the Independent Public Revenue Authority “Operation of the platform “Electronic Property File” for the execution of transactions on real estate – Replacement of the joint decision of the Ministers of Finance, Labour and Social Security, Environment and Energy, Digital Governance, State and the Governor of the Independent Public Revenue Authority “Operation of the platform “Electronic Property File” for the execution of transactions on real estate – Replacement of the joint decision of the Ministers of Finance, Labour and Social Security, Environment and Energy, Digital Governance, State and the Governor of the Independent Public Revenue Authority “Operation of the platform “Electronic Property File” for the execution of transactions on real estate”. 1617/9-3-2023 Joint Decision of the Ministers of Finance, Labour and Social Affairs, Environment and Energy, Digital Governance, State and the Governor of the Independent Public Revenue Authority “Pilot Operation of the “Electronic Property File” platform for the execution of real estate transactions” (B’2):

  1. Registrable notarial acts for which registration is requested in accordance with this Article shall be submitted in digital copy, in a readable portable document (.pdf ) format, and not as scanned files, and shall bear the notary’s digital signature, without handwritten references.
  2. the obligation to attach an extract of a cadastral map by the applicant for registration of a recordable deed to the digital property file is abolished. In this case, the cadastral map extract shall be digitally attached by the competent department of the Hellenic Cadastre, after the payment of the relevant fee by the applicant for registration, upon submission of the application for registration.
  3. the obligation to submit a simple copy of a certified extract of the cadastral map of paragraph 5. of Article 14 of Law No. 2664/1998, as well as an electronic diagram of par. 1 of Article 40 of Law No. 4409/2016.”
